c) The Website www.ayurmedixindia.com (“Website”) is owned and operated by Ayurmedix India (“Company”), a Private Company registered under the Companies Act, 2013. The Company’s registered office is located in Shahabad Markanda, Haryana, India.

d) Definitions: “You” or “User” refers to any legal person or entity accessing or using the services provided on the Website. “We,” “Us,” and “Our” refer to the Website and/or the Company. “Party” and “Parties” refer to the User and the Company individually and collectively.

e) Section headings in this Policy are for organizational purposes only and have no legal or contractual value.

f) Your use of the Website is governed by this Policy and the Terms of Use. By visiting the Website or using its services, you accept this Policy and the Terms. The Policy and Terms are considered co-terminus.

  1. DISCLOSURE/SHARING OF PERSONAL INFORMATION
  1. a) The User understands that Ayurmedix India may disclose personal information if required by law or in good faith belief that such disclosure is reasonably necessary to respond to legal processes, court orders, or subpoenas. Personal information may also be disclosed to law enforcement offices, third-party rights owners, or other parties to enforce the Terms or Policy, respond to claims of rights violations, or protect the rights, property, or safety of users or the general public.
  1. b) The User acknowledges that Ayurmedix India and its affiliates may share/sell some or all of their personal information with other business entities in the event of a merger, acquisition, reorganization, amalgamation, or restructuring. Such entities will be bound by the Terms and Policy, as amended.
  1. c) The User should be aware that Ayurmedix India may provide some personal information to third-party companies for marketing purposes. However, such companies cannot retain or use the User’s personal information beyond what is necessary to provide the product, service, or information, unless specific permission is granted to Ayurmedix India.
  1. d) The Company may disclose information as legally required, pursuant to governmental orders, or in good faith to conform to legal obligations, protect rights or property, prevent crime or ensure national security, or safeguard the personal safety of users or the public.
  1. THIRD PARTY ADVERTISEMENTS / PROMOTIONS

The User acknowledges that Ayurmedix India utilizes third-party advertising companies to display ads on the Website. These companies may use information about the User’s visits to the Website and other websites to deliver personalized advertisements. Additionally, the Website may contain links to other websites that collect personally identifiable information. The User understands that Ayurmedix India is not responsible for the privacy practices or content of linked websites, and the User assumes all associated risks.

  1. USER’S CONSENT

By using the Website or providing information to the Company through the Website, the User consents to the collection and use of their disclosed information in accordance with this Policy. This includes the User’s consent to Ayurmedix India sharing/divulging their information as stated in clause 2 of the Policy.

  1. DISPUTE RESOLUTION AND JURISDICTION

The Parties agree to resolve any disputes arising from this Policy through a two-step Alternate Dispute Resolution (ADR) mechanism. This section shall remain in effect even after the termination or expiry of the Policy and/or Terms.

  1. a) Mediation: The Parties will attempt to amicably resolve any dispute through mutual satisfaction. If a resolution cannot be reached within 30 days of one Party notifying the other Party of the dispute, the matter will proceed to arbitration.
  2. b) Arbitration: If mediation is unsuccessful, the dispute will be referred to arbitration with a sole arbitrator appointed by Ayurmedix India. The arbitrator’s decision will be binding on both Parties. Each Party will bear their own costs, though the arbitrator may direct one Party to cover the entire proceedings’ costs at their discretion. The arbitration will be conducted in English, with the seat of arbitration in Kurukshetra, Haryana, India.
